TERMS AND CONDITIONS

UNDERTAKING
Exclusiv Safaris undertakes to provide all services offered subject to the terms and conditions set out herein, which terms and conditions are accepted by the passenger.

DEFINITIONS
Services means: the provision of accommodation and/or transportation and/or meals and/or excursions offered by Exclusiv Safaris and accepted by the Passenger.
Passenger means: individuals, groups, companies or other legal persons using the services offered by Exclusiv safaris, and includes the agents of passengers.

STANDARD AND SAFETY
Exclusiv Safaris undertakes that:
All vehicles are safe and comply with relevant local safety regulations.
All drivers, guides and tour leaders are licensed in terms of local legislation.
The safety of passengers takes highest priority.

ACCOMMODATION, MEALS AND DRINKS
Accommodation is as specified in the itinerary and is based on two people sharing a twin or double-bedded room. Single accommodation, when available, will be at extra cost. The specified accommodation is subject to availability, and if not available, Exclusiv Safaris reserves the right to use alternative accommodation of equal value. This will in no way affect the price of the tour.
Meals included are as specified in the tour itinerary. Alcoholic and other drinks are for the account of the passenger.

TRANSPORTATION
Transportation is in air-conditioned coaches, minibuses or sedan vehicles. Exclusiv Safaris reserves the right to use the type of vehicle appropriate to the requirements of the specific tour.

PRICES
Prices are quoted in South African Rand, unless otherwise agreed upon. Bank charges will be for the account of the passenger or agent. Payment in approved foreign currency will be accepted at the rate of exchange applied by the bankers of Exclusiv Safaris at the date of receipt of payment. Any shortfall resulting from exchange rate fluctuations will be for the account of the passenger or agent.

PAYMENT
To confirm a booking, 25% (twenty-five percent) of the total tour price is payable on receipt of our invoice. The balance is payable 6 (six) weeks before departure. Bookings made within 6 weeks of departure must be accompanied by full payment. Payment by credit card is not accepted.

CANCELLATION FEES
Exclusiv Safaris must receive cancellation in writing and the following costs shall apply, calculated from the date of receipt of cancellation:

• Cancellation from the date of the invoice up to and including the 56th day before the day of departure:
  25% of the total tour price.
• Cancellation from the 56th day (included) to the 28th day before the day of departure:
  35% of the total tour price.
• Cancellation from the 28th day (included) to the 14th day before the day of departure:
  50% of the total tour price.
• Cancellation from the 14th day (included) to the 7th day before the day of departure:
  75% of the total tour price.
• Cancellation from the 7th day (included) to the day of departure or later:
  100% of the total tour price.
  

LUGGAGE
One bag of max. 65x45x25cm is allowed, plus one small overnight bag.
Exclusiv Safaris accepts no responsibility for loss or damage to luggage or personal belongings from whatsoever cause arising. Passengers are advised to take up adequate insurance cover.

SMOKING
Smoking is not permitted on board any of our vehicles; regular stops are included en route.
South Africa has strict laws on smoking, which must be adhered to at all times.

INSURANCES
Exclusiv Safaris complies with all legal requirements for the South African tourism industry and carries extensive passenger liability and other insurance. Passengers are responsible for their own personal, medical, travel and cancellation insurances.

ALTERATIONS
Exclusiv Safaris reserves the right to alter or cancel the itinerary, travel arrangements, accommodation and other arrangements at any time without prior notice and at the sole discretion of Exclusiv Safaris. Exclusiv Safaris shall not be responsible for any damages whatsoever arising from any such alteration or cancellation.

DELAYS
Exclusiv Safaris shall not be responsible for the consequences of any delays whether arising from accidents, breakdowns, or any other cause.

RESPONSIBILITY
Exclusiv Safaris shall not be responsible for any damages sustained by any passenger as a result of any act or omission whatsoever, of any employee, supplier or other person, notwithstanding the fact that Exclusiv Safaris acted as agent of such employee, supplier or other person.

LAWS
The law of the Republic of South Africa, or Neighbouring States (where applicable) shall govern the relationship between Exclusiv Safaris and the passenger, or Agent, and the Courts of the Republic of South Africa, or Neighbouring States (where applicable) shall have sole jurisdiction in respect of any claims and/or disputes which may arise between Exclusiv Safaris and the passenger, or Agent.
